data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>L&#8217;Audi\u00e8ncia Nacional [AN 11-12-2023] ha confirmat que l&#8217;empresa no pot modificar unilateralment l&#8217;estructura de la retribuci\u00f3 variable d&#8217;un pla d&#8217;incentius regulat al conveni col\u00b7lectiu. L&#8217;\u00fanic que pot canviar s\u00f3n els par\u00e0metres en qu\u00e8 fonamenta els objectius del pla.<\/p><p>L&#8217;estructura de la retribuci\u00f3 variable d&#8217;una empresa era del 70% d&#8217;acord amb els objectius del grup a qu\u00e8 pertany (amb base en quatre indicadors)\u00a0i del 30%\u00a0segons els objectius individuals pactats entre el treballador i el responsable directe. L&#8217;empresa va eliminar el percentatge d&#8217;incentiu d&#8217;acord amb els objectius individuals, de manera que el 100% depengu\u00e9s d&#8217;ella\u00a0(aplicant un multiplicador basat en el rendiment\u00a0de cada treballador).<\/p><p>Segons el Tribunal, es tracta d&#8217;una modificaci\u00f3 substancial que no es pot fer unilateralment, per la qual cosa \u00e9s nul\u00b7la.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f7500f4 elementor-widget elementor-widget-text-editor\" data-id=\"f7500f4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Festius locals<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-45bbab0 elementor-widget elementor-widget-text-editor\" data-id=\"45bbab0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En general, el calendari laboral de l&#8217;empresa ha de respectar els festius locals, per\u00f2 hi ha excepcions. El Tribunal Superior de Just\u00edcia de Cant\u00e0bria [TSJ Cant\u00e0bria 18-12-2024] ha declarat la validesa del calendari d&#8217;una empresa que estableix que els treballadors poden gaudir de les festes locals en dates diferents de les oficials i que han de preavisar l&#8217;empresa el dia abans del gaudi (tant si gaudeixen del festiu quan correspon com si opten per gaudir-lo en una altra data de la seva elecci\u00f3).<\/p><p>El tribunal no considera que el calendari laboral d&#8217;aquesta empresa s&#8217;hagi de declarar nul, per les raons seg\u00fcents:<\/p><ul><li>T\u00e9 el nombre de festius anuals establerts per la normativa.<\/li><li>La possibilitat de canviar el gaudi del festiu local a un altre dia, a la seva elecci\u00f3, afavoreix els treballadors.<\/li><li>Aquest r\u00e8gim va ser aprovat per la plantilla mateixa en assemblea convocada pel comit\u00e8 d&#8217;empresa.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7ceba12 elementor-widget elementor-widget-text-editor\" data-id=\"7ceba12\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Compet\u00e8ncia territorial<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8946caa elementor-widget elementor-widget-text-editor\" data-id=\"8946caa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Amb l&#8217;apogeu del teletreball, es plantegen dubtes sobre quin jutjat \u00e9s competent per resoldre conflictes entre el treballador i l&#8217;empresa. Legalment, la demanda s&#8217;ha de presentar als jutjats del lloc de prestaci\u00f3 de serveis o del domicili del demandat (que sol ser l&#8217;empresa).<\/p><p>Doncs b\u00e9, els tribunals [TSJ Madrid 30-11-2023] han resolt el seg\u00fcent:<\/p><ul><li>Si una part del treball \u00e9s presencial i una altra en teletreball, el lloc de prestaci\u00f3 de serveis \u00e9s el centre de treball i \u00e9s a aquests jutjats als quals s&#8217;ha d&#8217;acudir.<\/li><li>Si el treball es fa 100% a dist\u00e0ncia (i est\u00e0 regulat en un acord de teletreball on consta el domicili des del qual es treballa), els jutjats d&#8217;aquest domicili poden ser competents si aix\u00ed es preveu a l&#8217;acord de teletreball.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-63f52645
