class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Las empresas pueden reclamar a los trabajadores los salarios indebidamente percibidos. Esta reclamaci\u00f3n se podr\u00e1 hacer mientras la relaci\u00f3n laboral est\u00e9 vigente, en el momento de la firma del finiquito por el que se consideran liquidadas las partes o incluso despu\u00e9s de la finalizaci\u00f3n del contrato. Sin embargo, hay que tener en cuenta lo siguiente:<\/p><ul><li>La acci\u00f3n prescribe al a\u00f1o, por lo que no es posible reclamar los salarios indebidamente percibidos por el trabajador despu\u00e9s de m\u00e1s de 12 meses.<\/li><\/ul><ul><li>El c\u00f3mputo de estos 12 meses se interrumpe (y se reinicia desde el principio) si la empresa realiza una reclamaci\u00f3n extrajudicial contra el trabajador para recuperar estas cantidades.<\/li><\/ul><p>En cualquier caso, el exceso satisfecho no podr\u00e1 ser considerado como una mejora salarial que haya consentido o aceptado. Esto podr\u00eda ocurrir si se trata de una situaci\u00f3n continuada; por ejemplo, si el error se ha mantenido durante unos a\u00f1os y hay evidencias de que la empresa lo sab\u00eda en su momento, pero, sin embargo, no hizo nada por corregirlo, por lo que el trabajador consider\u00f3 de buena fe que se trataba de una mejora aceptada por la direcci\u00f3n. Si se trata de una condici\u00f3n m\u00e1s beneficiosa, no puede reclamarse (este derecho adquirido s\u00f3lo podr\u00eda eliminarse mediante una modificaci\u00f3n sustancial de las condiciones de trabajo).<\/p><p>Se reclamar\u00e1n los excesos satisfechos por su cantidad bruta:<\/p><ul><li>Las retenciones tributarias se considerar\u00e1n a cuenta del IRPF definitivo. Por tanto, el afectado podr\u00e1 recuperar todo lo pagado en exceso a Hacienda (el IRPF pagado en exceso, dentro del cual estar\u00e1n las retenciones), solicitando \u00e9l mismo la devoluci\u00f3n de ingresos indebidos.<\/li><\/ul><ul><li>Por lo que respecta a la Seguridad Social con cargo al afectado y retenida en exceso, ser\u00e1 tambi\u00e9n este \u00faltimo quien deber\u00e1 solicitar la devoluci\u00f3n una vez consolidada la base de cotizaci\u00f3n definitiva.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-339a4c2d
