class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En un local que se alquila como espacio libre, sin ning\u00fan elemento excepto las tomas de corriente y suministros, que requiere construir lavabos, levantar paredes, tramitar licencias, etc.:<\/p><ul><li>El arrendador no estar\u00e1 obligado a adecuar el local para desarrollar una actividad concreta ni a tramitar licencias u otros permisos.<\/li><li>Aunque puede pactarse lo contrario, lo habitual es que sea el arrendatario quien asuma el coste de estos tr\u00e1mites. Y para evitar disputas al final del contrato sobre si puede retirar las obras o recibir una indemnizaci\u00f3n por devolver un local \u201cmejorado\u201d, hay que dejarlo todo previsto de antemano.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8f57337 elementor-widget elementor-widget-text-editor\" data-id=\"8f57337\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Gestiones precias<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-819f09e elementor-widget elementor-widget-text-editor\" data-id=\"819f09e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>El primero ser\u00e1 verificar si podr\u00e1 desarrollar su actividad concreta, seg\u00fan d\u00f3nde se ubique el local, y consultar al Ayuntamiento qu\u00e9 licencias necesitar\u00e1 y cu\u00e1nto tardar\u00e1 en obtenerlas. Dado que esto comportar\u00e1 un tiempo, habr\u00eda que pactar una reserva de arrendamiento mientras se realizan estas gestiones. El siguiente paso ser\u00e1 realizar un estudio de las obras a realizar, de su coste y de su alcance, para poder decidir le interesa el local y, si es as\u00ed, ver si necesita pactar un plazo de carencia de pago mientras se llevan a cabo las obras.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-814cc97 elementor-widget elementor-widget-text-editor\" data-id=\"814cc97\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>\u00bfQu\u00e9 ocurrir\u00e1 con las obras?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b8ce4f4 elementor-widget elementor-widget-text-editor\" data-id=\"b8ce4f4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Legalmente, el inquilino debe devolver el local en el mismo estado en el que se le arrend\u00f3 (es decir, todas las mejoras le pertenecen). Si ha utilizado materiales de gran calidad, estar\u00e1 interesado en llev\u00e1rselos al final del contrato. Evidentemente, si desmonta las obras, deber\u00e1 dejar el local en estado similar al que se le entreg\u00f3; no podr\u00e1 dejar destrozos. Sin embargo, lo mejor es hacer constar expresamente en el contrato qu\u00e9 pasar\u00e1 con las obras:<\/p><ul><li><em>Las obras son del arrendatario.<\/em>\u00a0Si se pacta que las obras pertenecen al arrendatario, \u00e9ste deber\u00e1 asumir el coste de desmontarlas y llev\u00e1rselas.<\/li><li><em>Las obras quedan en beneficio de la propiedad.\u00a0<\/em>Este pacto es habitual. As\u00ed, al finalizar el contrato el propietario recupera un local \u201cmejorado\u201d y el inquilino no debe volver a pagar por dejarlo como estaba. La inversi\u00f3n puede compensarse con una carencia inicial. Habr\u00e1 que calcular la cantidad que el inquilino se gast\u00f3 con las obras para pactar un plazo del arrendamiento que le permita amortizarlas.<\/li><\/ul><p>Se podr\u00eda pensar que, si se entrega un local \u201cde origen\u201d y se vuelve \u201cmejorado\u201d, existe un enriquecimiento injusto, pero los tribunales consideran que, si as\u00ed se ha pactado, el enriquecimiento es leg\u00edtimo, algo que no impide que se pueda pactar una indemnizaci\u00f3n. Adem\u00e1s, se considera que dentro del concepto &quot;obras que deben quedar en beneficio del local&quot; entran los elementos fijos y estables (sanitarios, ventilaci\u00f3n\u2026), pero no el stock, el mobiliario o los electrodom\u00e9sticos, por ejemplo.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-339a4c2d elementor-widget
