class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En el seguro de cauci\u00f3n, el contratante tiene una obligaci\u00f3n pendiente de ejecuci\u00f3n (por ejemplo, una obra) y, para garantizar su cumplimiento, contrata este seguro, por el que abonar\u00e1 una indemnizaci\u00f3n en caso de incumplimiento. As\u00ed, el responsable de la obligaci\u00f3n es el tomador, siendo la persona ante la que se obliga \u2013el destinatario de la obra\u2013 el asegurado y el beneficiario del seguro.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-285db4b elementor-widget elementor-widget-text-editor\" data-id=\"285db4b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Caracter\u00edsticas de esta garant\u00eda<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-21faaa8 elementor-widget elementor-widget-text-editor\" data-id=\"21faaa8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Contratar un seguro de cauci\u00f3n ofrece m\u00e1s ventajas que aportar un aval bancario o disponer de recursos financieros propios:<\/p><ul><li><em>Costes.\u00a0<\/em>Es un medio m\u00e1s econ\u00f3mico que un aval (que implica gastos de constituci\u00f3n y mantenimiento) y no requiere inmovilizaci\u00f3n de saldo en cuenta.<\/li><li><em>A nivel contable.<\/em>\u00a0No computar\u00e1 como pasivo dentro de la contabilidad de la empresa, ni como deuda de cara al c\u00e1lculo del nivel de endeudamiento. Adem\u00e1s, no aparece en el CIRBE.<\/li><li><em>Solvencia.<\/em>\u00a0Para suscribir este seguro, la aseguradora realiza un an\u00e1lisis de la obligaci\u00f3n asumida y de la capacidad econ\u00f3mica del asegurado. Si tiene la solvencia necesaria, dispondr\u00e1 de un &quot;certificado de seguro de cauci\u00f3n&quot;, que tendr\u00e1 una influencia positiva en su imagen corporativa.<\/li><\/ul><p>En cuanto a sus caracter\u00edsticas, cabe destacar que, en caso de incumplimiento, todas las cantidades que la aseguradora abone al beneficiario deben ser devueltas por el tomador. Por eso, la ley permite pactar libremente el l\u00edmite de la indemnizaci\u00f3n con el asegurado. Y el coste puede variar seg\u00fan m\u00faltiples factores (el tipo de obligaci\u00f3n garantizada, la solvencia, el plazo del cumplimiento de la obligaci\u00f3n\u2026), si bien suele situarse entre el 0,5 y el 3% del valor de la obligaci\u00f3n asegurada.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9833bbb elementor-widget elementor-widget-text-editor\" data-id=\"9833bbb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Supuestos habituales<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0bccc75 elementor-widget elementor-widget-text-editor\" data-id=\"0bccc75\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Estos seguros son muy habituales en el \u00e1mbito p\u00fablico. En muchas ocasiones la Administraci\u00f3n las requiere y suelen constar como condici\u00f3n b\u00e1sica para poder optar a la licitaci\u00f3n, para evitar que resulte adjudicatario alguien con riesgo de insolvencia futura. En el \u00e1mbito privado, este seguro es muy habitual en las ejecuciones de obra sobre plano. Incluso existen actividades en las que es obligatoria la suscripci\u00f3n de estos seguros:<\/p><ul><li><em>Agencia de viajes.\u00a0<\/em>Para cubrir las cantidades recibidas a cuenta de un viaje si al final no se realiza. Cuanto m\u00e1s complejo es el viaje, mayor sentido tiene el seguro de cauci\u00f3n.<\/li><li><em>Inmobiliarias.\u00a0<\/em>Cubrir\u00edan las cantidades recibidas por el comprador en una compraventa que no llegue a consumarse. Si se hubiesen entregado arras al vendedor, este seguro evitar\u00eda tener que reclamar judicialmente la devoluci\u00f3n duplicada en caso de desistimiento.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-339a4c2d elementor-widget elementor-widget-text-editor\"
