class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Para reducir la plantilla por razones econ\u00f3micas, t\u00e9cnicas, organizativas o de producci\u00f3n (ETOP), la empresa debe recurrir a los despidos individuales objetivos o al procedimiento de despido colectivo en funci\u00f3n del n\u00famero de trabajadores afectados. Se debe tramitar un despido colectivo cuando los ceses afecten, en un plazo de 90 d\u00edas, a 10 o m\u00e1s trabajadores en empresas con menos de 100 trabajadores, adem\u00e1s del 10% en empresas con entre 100 y 300 trabajadores oa m\u00e1s de 30 trabajadores en empresas con m\u00e1s de 300.<\/p><p>Para este c\u00e1lculo, adem\u00e1s de los despidos objetivos por causas ETOP, deben computarse los siguientes tipos de extinciones:<\/p><ul><li>Los despidos disciplinarios reconocidos como improcedentes fraudulentamente.<\/li><\/ul><ul><li>Las extinciones indemnizadas despu\u00e9s de una modificaci\u00f3n sustancial de las condiciones laborales.<\/li><\/ul><ul><li>Las extinciones por la no superaci\u00f3n del per\u00edodo de prueba si afectan simult\u00e1neamente a un gran n\u00famero de empleados.<\/li><\/ul><ul><li>Las extinciones voluntarias del trabajador causadas por incumplimientos por parte del empresario (ET, art. 50).<\/li><\/ul><ul><li>La falta de llamada de trabajadores fijos-discontinuos en el momento habitual (por ejemplo, en el sector educativo cada mes de septiembre).<\/li><\/ul><p>Adem\u00e1s, si en el plazo de 90 d\u00edas se producen al menos cinco extinciones mutuamente acordadas, los tribunales verificar\u00e1n quien es el verdadero responsable de la rescisi\u00f3n del contrato. Cuando la decisi\u00f3n haya sido tomada por la empresa (aunque sea de mutuo acuerdo), el despido se computar\u00e1 dentro del plazo de 90 d\u00edas. En definitiva, aunque estas extinciones deber\u00edan excluirse porque no dependen de la voluntad del empresario, los tribunales las computan cuando no se producen de forma aislada e individual y responden a un programa de bajas incentivadas.<\/p><p>Por el contrario, no es necesario a\u00f1adir las extinciones v\u00e1lidas de los contratos temporales, ni los despidos objetivos por ineptitud sobrevenida, por falta de adaptaci\u00f3n o por faltas de asistencia.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-339a4c2d elementor-widget
