class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Si, a pesar de tener buenas perspectivas a medio plazo, las previsiones para este a\u00f1o todav\u00eda muestran p\u00e9rdidas que dejar\u00e1n su patrimonio neto por debajo de la mitad del capital social, su empresa entrar\u00e1 en causa de disoluci\u00f3n. En este caso, es normal regularizar la situaci\u00f3n con una ampliaci\u00f3n de capital, que implica escritura p\u00fablica y registro (es decir, tr\u00e1mites y gastos).<\/p><p>Sin embargo, estas situaciones tambi\u00e9n pueden resolverse sin necesidad de acudir al notario e incurrir en gastos. En concreto, mediante una aportaci\u00f3n no reintegrable de los socios:<\/p><ul><li>Con esta aportaci\u00f3n, los socios ingresan en la sociedad el importe necesario. Habr\u00e1 que firmar un documento reconociendo que la aportaci\u00f3n se hace a fondo perdido (como \u201caportaci\u00f3n de los socios para reparar las p\u00e9rdidas\u201d).<\/li><\/ul><ul><li>De esta forma, en el balance aparecer\u00e1 el importe como fondos propios de la SL y no como deuda (ya que los socios no lo reclamar\u00e1n). As\u00ed, se recuperan los fondos propios y se regulariza la situaci\u00f3n sin m\u00e1s tr\u00e1mites.<\/li><\/ul><p>Ahora bien, dado que esta operaci\u00f3n implica que los socios entreguen dinero que no van a reclamar, su tratamiento fiscal es el siguiente:<\/p><ul><li><em>Sociedad<\/em>. Su importe no se computar\u00e1 como ingreso, sino como aportaci\u00f3n a los fondos propios. Por tanto, la sociedad no tendr\u00e1 ning\u00fan gasto fiscal.<\/li><\/ul><ul><li><em>Socios<\/em>. Para los socios, el importe entregado ser\u00e1 un mayor coste de sus participaciones en la SL (de forma que, si se produce una venta futura, el beneficio eventual y su tributaci\u00f3n ser\u00e1n inferiores). Si existen varios socios, ser\u00e1 necesario que cada uno aporte la cantidad que le corresponda (en proporci\u00f3n a su participaci\u00f3n en el capital). Si alg\u00fan socio aporta m\u00e1s de lo que le corresponde, habr\u00e1 gastos fiscales (por ejemplo, Hacienda podr\u00eda considerar que este exceso es una donaci\u00f3n a favor del resto de
