class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En ese contexto, la cesi\u00f3n del local implica una cesi\u00f3n del contrato de arrendamiento. Por tanto, lo primero que hay que comprobar es qu\u00e9 dice sobre la cesi\u00f3n. En los alquileres de locales de negocio, la ley da un amplio margen para pactar, por lo que debe cumplirse con lo acordado en su d\u00eda. V\u00e9anse los posibles escenarios.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-de415b9 elementor-widget elementor-widget-text-editor\" data-id=\"de415b9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La cesi\u00f3n est\u00e1 expresamente permitida<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5dc6585 elementor-widget elementor-widget-text-editor\" data-id=\"5dc6585\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Si el contrato lo prev\u00e9 y lo permite, es muy probable que tambi\u00e9n indique en qu\u00e9 condiciones debe llevarse a cabo y sus consecuencias. Sin embargo, aunque existan condiciones en el contrato, siempre es posible negociar (y es conveniente hacerlo). Lo habitual es establecer lo siguiente:<\/p><ul><li>Que debe comunicarse el cambio de inquilino al propietario.<\/li><\/ul><ul><li>Que el propietario tendr\u00e1 derecho a incrementar el alquiler por el hecho de la cesi\u00f3n o incluso que tendr\u00e1 derecho a cobrar un porcentaje de la cesi\u00f3n.<\/li><\/ul><ul><li>Otra posibilidad es que el contrato s\u00f3lo indique que en el momento de ceder el contrato se requerir\u00e1 autorizaci\u00f3n expresa del arrendador (propietario), sin m\u00e1s. Si es as\u00ed, debe saber que en caso de cesi\u00f3n, la ley permite al arrendador aumentar el alquiler en un 20% (a menos que se renuncie a ello en el contrato). Por tanto, si no lo ha hecho, es probable que ponga un precio a esta autorizaci\u00f3n. Intente negociarlo.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2ccd766 elementor-widget elementor-widget-text-editor\" data-id=\"2ccd766\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>El contrato no dice nada<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3b1d6f5 elementor-widget elementor-widget-text-editor\" data-id=\"3b1d6f5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Si el contrato no regula espec\u00edficamente la cesi\u00f3n o si se hace referencia expresa a la ley, se aplicar\u00e1 lo dispuesto en la Ley de Arrendamientos Urbanos en los supuestos de cesi\u00f3n del contrato: el local podr\u00e1 ser cedido sin necesidad de autorizaci\u00f3n previa por parte del propietario. As\u00ed, ser\u00e1 suficiente que se le notifique la transmisi\u00f3n de forma fehaciente en el plazo de un mes, a contar desde el momento en que se realice esta transmisi\u00f3n, y el propietario tendr\u00e1 derecho en todo caso a incrementar en un 20% la renta que est\u00e9 vigente en ese momento. Por otra parte, no tendr\u00e1 derecho a exigir parte de lo cobrado como transferencia.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b3438c3 elementor-widget elementor-widget-text-editor\" data-id=\"b3438c3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Alternativa al traspaso<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b89744c elementor-widget elementor-widget-text-editor\" data-id=\"b89744c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Si se opera a trav\u00e9s de una sociedad \u2013que es la que figura como arrendataria\u2013 y lo que se hace es vender la totalidad de las participaciones, no se considera una cesi\u00f3n (a menos que el contrato indique lo contrario).
