class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Si un cliente no paga una factura, transcurrido un a\u00f1o desde el devengo de la operaci\u00f3n podr\u00e1 llevar a cabo los tr\u00e1mites para recuperar el IVA transferido (si su empresa factura menos de 6.010.121,04 euros anuales<i>,\u00a0<\/i>s\u00f3lo tendr\u00e1 que esperar seis meses para iniciar estos tr\u00e1mites). En ambos casos, tendr\u00e1 seis meses para completarlos.<\/p><p>No obstante, si antes de finalizar estos plazos su cliente se declara en concurso, deber\u00e1 anticiparse a los procedimientos de recuperaci\u00f3n del IVA:<\/p><ul><li>Debe emitir la factura rectificativa dentro de los tres meses siguientes a su publicaci\u00f3n en el Bolet\u00edn Oficial del Estado del auto concursal y enviarla al deudor (con copia al administrador concursal).<\/li><\/ul><ul><li>Dispondr\u00e1 de un mes desde la emisi\u00f3n de la factura rectificativa para comunicar a Hacienda \u2014a trav\u00e9s del formulario espec\u00edfico que aparece en su Sede Electr\u00f3nica\u2014 que has realizado esta rectificaci\u00f3n.<\/li><\/ul><p>En este sentido, el administrador concursal comunicar\u00e1 a todos los acreedores la publicaci\u00f3n del auto de declaraci\u00f3n de concurso. No obstante, podr\u00eda retrasarse en este tr\u00e1mite, con el riesgo de que su empresa no pueda llevar a cabo la rectificaci\u00f3n a tiempo. Vea c\u00f3mo reducir este riesgo:<\/p><ul><li>Si sospecha que un cliente entrar\u00e1 en concurso de acreedores, consulte peri\u00f3dicamente el Tabl\u00f3n Edictal Judicial \u00danico del BOE (apartado de \u201cEdictos Judiciales\u201d), en el que se publican los anuncios de concurso de acreedores.<\/li><\/ul><ul><li>En la p\u00e1gina web\u00a0<strong><a href=\"https:\/\/www.publicidadconcursal.es\/\" target=\"_blank\" rel=\"noopener\">www.publicidadconcursal.es<\/a><\/strong>\u00a0tambi\u00e9n se puede comprobar si un deudor est\u00e1 en concurso de acreedores (aunque en la pr\u00e1ctica la informaci\u00f3n tarda un poco m\u00e1s en aparecer que en el BOE).<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div
